The Landlord and Tenant Bill, 2021

On 12th February 2021, the Landlord and Tenant Bill, 2021 (the Bill) was gazetted, seeking to update and consolidate various laws relating to both commercial and residential tenancies in Kenya. If enacted, it shall repeal the Distress for Rent Act, the Rent Restriction Act and the Landlord and Tenant (Shops, Hotels and Catering Establishments) Act (the Landlord and Tenant Act).

The current regulation of landlord-tenant relationships is dispersed across these three statutes, which were enacted between the 1940s to 1960s and have changed little since.

In this article, we review some of the salient features proposed in the Bill, and the potential impact of these developments.
