Retail Trade Code of Practice

On the 11th of June 2021, the Competition Authority of Kenya published the Retail Trade Code of Practice (RTCP). The RTCP was prepared by the Retail Trade Association of Kenya (RETRAK), Kenya Association of Manufacturers (KAM) and the Association of Kenya Suppliers (AKS) pursuant to an invitation by the Competition Authority of Kenya and gazetted by the Competition Authority pursuant to Section 24A(8) of the Competition Act. The RTCP is aimed at streamlining the commercial relationship between suppliers and retailers. The RTCP will have a major impact on retailers in particular, as its other goal is to reduce instances of abuse of buyer power.

The Competition Authority also recently published template model contracts for use by buyers & suppliers in the retail sector in order to cultivate a culture of contracting parties adopting written commercial agreements and facilitate compliance with the Competition Act.
