Amendments to the Employment Act, 2007 to Include Leave for Adopting Parents

On 30th March 2021, the president assented to the Employment (Amendment) Act, 2021 (Amendment Act) which contains amendments to the the Employment Act, No. 11 of 2007.

This Amendment Act adds a new Section 29A after Section 29 of the Employment Act, No. 11 of 2007 which originally only provided for a 3-month maternity leave for female employees and a 2-week paternity leave for male employees. There were no provisions that allocated leave days for those in the process of adopting a child/children which therefore did not give these adoptive parents an opportunity to bond with their adopted child/children.
